Barfly Diners — Terms of Service

Plain-English summary: Barfly Diners is a free, private journal for bars and restaurants. Use it responsibly, you must be of legal drinking age, the place data comes from third parties so it won't be perfect, and your journal is your responsibility to back up. We provide the app "as is."

By downloading or using Barfly Diners (the "App"), you agree to these Terms.

1. Eligibility

You must be of legal drinking age in your jurisdiction (21+ in the United States) to use the App. The App is intended for adults and is not directed to minors.

2. The service

Barfly Diners is a local-first dining journal: it stores your saved places, notes, visits, and photos on your device and helps you discover bars and restaurants using third-party place data.

No account is required. Some features rely on your device's location and an internet connection.

3. Your content & your responsibility to back up

Everything you record stays on your device. We do not store a copy. You are responsible for backing up your journal (Settings → Back up). We are not responsible for any loss of your data — for example if you lose, reset, or replace your device, or clear app storage.

4. Acceptable use

You agree not to:

• use the App for any unlawful purpose;
• attempt to disrupt, overload, abuse, or reverse-engineer the App or its backend services

(including automated/excessive requests to our APIs);

• misuse the place data or attempt to scrape or resell it.

We may rate-limit or block abusive usage.

5. Place data & accuracy

Place information (names, locations, categories, hours) comes from third-party providers including Google and OpenStreetMap contributors. It may be incomplete, outdated, or inaccurate. We do not guarantee that any place exists, is open, serves what's listed, or is suitable for you.

Verify details independently before relying on them.

6. Responsible enjoyment

Barfly Diners is about enjoying bars and restaurants responsibly. Never drink and drive. You are solely responsible for your own choices and conduct.

7. Third-party services

The App uses third-party services (e.g. Google Places, OpenStreetMap, your device's map app). Your use of those is also subject to their terms. We are not responsible for third-party services.

8. Free app; future paid features

The diner app is free. Future versions may offer optional paid features or separate products (e.g. tools for venue managers) under their own terms. Those are not part of the free diner app unless you choose them.

9. Intellectual property

The App, the "Barfly Diners" name, and its branding are owned by the Operator. Place data belongs to its respective providers. You may not copy or redistribute the App or its branding without permission.

10. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or that place data will be accurate.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP. Because the App is free, our total liability is limited to the greater of the amount you paid (if any) or USD $10.

12. Changes

We may update the App and these Terms. Continued use after changes means you accept the updated Terms.

13. Termination

You may stop using the App at any time by uninstalling it. We may suspend access for abuse or violations of these Terms.

14. Text messaging (SMS)

If you contact our business line (205) 922-7359 by call or text, or provide your mobile number to us, you consent to receive one-to-one, conversational replies from Barfly Diners' owners and staff about your inquiry. Message frequency varies; message and data rates may apply. Reply STOP to opt out or HELP for help. We do not sell or share mobile numbers or SMS consent data with third parties for their marketing. 15. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of- law rules. Disputes will be handled in the state or federal courts located in Texas.
